"MNA Broadcasting"
means MNA Broadcasting and any company which is a subsidiary
or holding company (as those expressions are defined in Section
736 of the Companies Act 1985) of MNA Broadcasting and any
subsidiary of any such holding company or any of them; and
"Company" means MNA Broadcasting and “Radio
Station” means 107.2 The Wyre.
The Radio Station’s competitions are intended simply
to be fun and are not intended to create legal relations between
the entrant to any such competition and any of the Radio Station
or Company. Unless otherwise stated, no purchase or payment
of any kind is required for entry.
Where participation of the competition involves utilising
a premium rate telephone line either for voice or text messages
we will adhere to the ICSTIS Rules. Calls will normally cost
a premium charge plus the standard rate of your mobile network
provider. You should check with your network for more details.
For the avoidance of doubt the cost of calls from different
mobile phone service providers may vary.
The competition is organised by the Company.
Unless otherwise stated, any entry to
the competition should be telephone, e-mailed or text-messaged
to the Radio Station. Unless otherwise stated, text messages
to the Radio Station are charged at twenty five pence (25p)
plus standard network rate. Telephone call costs may vary
depending upon network operator.
The Company will notify the winner either by broadcast, by
telephone or in writing of the arrangements for collection
or delivery of a prize. Any prize not claimed and/or collected
within 28 days of the first notification shall remain the
property of the Company, which shall be entitled to dispose
of such prize in its absolute discretion. The Company shall
use its reasonable endeavours to ensure that prizes are received
by the actual winner but it accepts no responsibility for
any failure to do so. Please allow 28 days for delivery of
a prize.
All competition entrants agree to abide by these terms and
conditions and submission of an entry or participation in
a competition shall be deemed to indicate acceptance of these
terms and conditions. The Company assumes (and you warrant)
that by entering the competition you either have legal capacity
to enter the competition and agree to the terms and conditions
(i.e. that you are of sufficient age and mental capacity and
are entitled to be legally bound in contract) or that your
parents/guardian have consented to your entry of the competition
and use of these terms and conditions. All entries shall become
the property of the Company and shall not be returned unless
otherwise agreed in advance.
By entering the competition you hereby warrant that all information
submitted by you is true, correct, current and complete. Any
information submitted by you must be personal to and relate
specifically to you. You warrant that the information which
you submit and/or distribute will not infringe the intellectual
property, privacy or any other rights of any third party,
and will not contain anything which is libelous, defamatory,
obscene, indecent, harassing or threatening. The Company reserves
the right to screen, filter and/or monitor information provided
by you and to edit, refuse to distribute or remove the same
including the right to refuse an entry.
To qualify to enter any competition, you must be resident
in the United Kingdom.
Competitions are not open to employees of the Radio Station,
Company or MNA Broadcasting or members of their immediate
families (including spouses, parents, grandparents, children,
brothers, sisters, uncles, aunts, cousins and remoter issue),
their agents, participating clients or anyone connected with
the promotion of the competition and in the event of any dispute
over the eligibility of a participant the decision of the
Company shall be final.
Unless otherwise stated, only one entry per person shall be
permitted. Incomplete or indecipherable entries will be void
(in the Radio Station’s absolute discretion).
We reserve the right, in our absolute discretion, to request
proof of identity in the form of your passport, driving license
and a utility bill bearing your address.
A person or people of the same residential address may not
win more than one prize valued at £500 or greater within
a 6 month period following each win.
Where the competition has a closing date and/or time, all
entries must be received before such date and/or time. Late
entries will not be taken into consideration in the selection
of a winner. Neither the Radio Station nor the Company accepts
any responsibility for the non-delivery, delay or loss of
any entry. Proof of posting shall not be acceptable as proof
of delivery.
Where the competition may be won by a numbered caller or participant,
the selection of the winning entrant shall be at the Radio
Station’s sole discretion.
Neither the Radio Station nor the Company shall be responsible
for any damage, loss, injury or disappointment suffered by
any entrant entering the competition or as a result of accepting
any prize. Neither the Radio Station nor the Company shall
be responsible for any problems or technical malfunction of
any telephone network or lines, computer on-line system, servers
or providers, computer equipment, software failure of any
e-mail or entry to be received on account of technical problems
or traffic congestion on the Internet, telephone lines or
at any website, or any combination thereof, including any
injury or damage to any entrant’s or any other person’s
computer or mobile telephone related to or resulting from
participation in or downloading any materials in the competition.
Nothing shall exclude the Company’s liability for death
or personal injury as a result of its negligence.
Cash prizes will be paid by cheque, payable to the winning
entrant. The Company accepts no responsibility for any lost
or misappropriated cheque.
Cash alternatives shall not be offered to a non-cash prize.
In the event of a stated prize being unavailable for any reason,
the Company may, where appropriate and in its sole discretion,
arrange for the supply of an alternative prize of similar
value. All prizes are non transferable and may not be given
or assigned to another person.
In the event that there is more than one entry qualifying
as a prospective winner of a prize which is by its nature
divisible (for example a cash prize) then such prize shall
be shared, subject to the decision of the Company in respect
of prize money not to extend beyond the aggregate amount broadcast
as available in any one competition or, in a competition consisting
of a series of games, beyond the maximum aggregate amount
broadcast in relation to or allocated to any one game in the
series, or the total for the entire series. In the event of
there being more than one prospective winner of a prize which
is not by its nature divisible the decision of the Company
as to the ultimate winner shall be final.
Entries to certain competitions may be subject to age restrictions.
Entrants who do not comply with such restrictions will be
disqualified. Entrants who enter under a false name or give
a false address for their entry will also be disqualified.
In some circumstances, winners under 18 years of age must
be accompanied on a trip or holiday or to an event by a parent
or guardian or other responsible adult.
Additional eligibility requirements may apply to a specific
competition e.g. a valid passport, visas and/or driver’s
licence will be required if the competition prize includes
travel outside the United Kingdom and/or car hire.
You must take all reasonable steps to ensure your own health
and safety. Any behaviour or act or conduct by you which the
Radio Station considers to pose any medical security or safety
risk may lead to your immediate disqualification.
You are obliged to take all reasonable steps to ensure the
safety standards and the general appropriateness of activities
undertaken during the competition and acknowledge that all
activities are undertaken at your own risk. The Radio Station
and Company reserve the right to forfeit your place on the
competition or the prize (without liability or compensation)
if, in its reasonable opinion, you may expose yourself or
others to risk of illness or injury or to the cancellation,
disruption or curtailment of the competition.
All taxes, insurances, transfers, spending money and other
expenses, unless specifically stated, are the sole responsibility
of the prize-winner.
A prize will not be awarded to a person who, for any reason,
would not be allowed by law to purchase or use the prize or
where the supply of the prize to that person would be unlawful.
All entrants agree to their name and home town being published
on the air and elsewhere. Entrants agree to their participation
being broadcast, recorded, repeated and otherwise used for
any reason by the Radio Station or the Company without being
entitled to any payment for such use. The winner may be required
by the Radio Station to participate in a photo, video and/or
film session and the winner hereby acknowledges that the Radio
Station and the Company have the right to use such photos,
videos or films in any medium and in any reasonable manner
for any purpose as they may see fit.
The winning entry and the name and county of competition winners
may be made available by the Company after a specified date
to any person applying for such information to the competition
address and enclosing a stamped addressed envelope, having
marked such application “Results”.
The Company reserves the right to reject entries, applications
or claims and to alter, amend or foreclose the competition
without prior notice in its absolute discretion. The Company
reserves the right to disqualify any entrant if it has reasonable
grounds to believe the entrant has breached any of these terms
and conditions.
Complaints about the operation of a competition should be
made in writing to the Managing Director, P. Wagstaff.
The decision of the Company in relation to a competition is
final and no correspondence will be entered into relating
to the Company’s decision or interpretation of these
terms and conditions.
The competition and the terms and conditions of it will be
governed by English law and you and we agree to submit to
the exclusive jurisdiction of the English courts.
